Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Nex-Sign electronic-signature platform and API (the "Service"), operated by Nex-Sign ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Nex-Sign lets you send documents for electronic signature via our API and hosted signing pages. We convert your documents, deliver signing invitations, capture signatures, and return signed documents and a sealed PDF record.

2. Accounts & API access

  • You are responsible for activity under your account and for keeping your API tokens secret.
  • You must provide accurate information and are responsible for your end signers' consent to sign electronically.
  • You must not use the Service for unlawful, fraudulent, or abusive purposes.

3. Documents & content

You retain ownership of the documents and data you submit. You grant us the limited right to process and store them solely to provide the Service. You are responsible for ensuring you have the right to send the documents you submit.

4. Credits, billing & refunds

  • The Service is sold as prepaid document credits. Purchased credits are valid for 12 months from purchase.
  • Trials provide a limited number of documents for a limited time and require no payment card.
  • Payments are processed by Stripe; by purchasing you also agree to Stripe's terms. Prices are stated at checkout.
  • Except where required by law, purchased credits are non-refundable once consumed.

5. Availability

We aim for high availability but the Service is provided "as is" without warranty of uninterrupted operation. We may modify or discontinue features with reasonable notice.

6. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

7. Legal validity of signatures

Nex-Sign provides Simple Electronic Signatures. While we produce a tamper-evident sealed record and an audit trail, you are responsible for determining whether an electronic signature meets the legal requirements applicable to your use case and jurisdiction.

8. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms. Legal signing records are retained as required by law.
